Legal battle over for Collegian photographer

Centre County District Attorney Stacy Parks Miller will not pursue charges against Daily Collegian photographer Michael Felletter stemming from a riot in 2008, according to a press release.

Parks Miller, who called the case a "waste of resources" during her campaign last year, filed a motion to discontinue an ongoing appeal.

Felletter (senior-visual journalism) was charged with five counts of misdemeanor failure to disperse and one count of misdemeanor disorderly conduct after taking pictures of a riot that erupted following Penn State's football victory over Ohio State on Oct. 25, 2008.

The case was initially dropped in January 2009, but was re-filed in March with one count of failure to disperse bound over for trial. Centre County Judge David E. Grine dismissed the remaining charge in July due to unclear evidence.

A week later, former District Attorney Michael Madiera filed an appeal to the Superior Court.

After reviewing the facts and legal issues surrounding the case, officials found the appeal should be dropped "in the interest of justice," according to court documents.
