Students charged with furnishing

The charges were filed in connection with the Sept. 21 death of PSU

Two fraternities, a fraternity member and the roommate of Penn State freshman Joseph Dado's sister were all charged Thursday with furnishing alcohol in connection with Dado's death.

Alpha Tau Omega fraternity, Phi Gamma Delta (Fiji) fraternity, Fiji member John Townsend and Natalie Dado's roommate Jennifer E. Clifford, 21, are all charged with furnishing alcohol to the 18-year-old Dado in the time leading up to his death, police said.

Maintenance workers found Dado dead Sept. 21 in an exterior stairwell near the Steidle Building, police said.

Toxicology test results showed that the freshman from Latrobe had a blood alcohol content (BAC) of .169 percent -- more than double the legal Pennsylvania driving limit for those over 21.

Dado and three friends visited Alpha Tau Omega, 321 E. Fairmount Ave., and Phi Gamma Delta (Fiji), 319 N. Burrowes Road, police said. After leaving Alpha Tau Omega, the group stopped at Dado's sister's Burrowes Corner apartment, police said. At about 1:50 a.m. on Sept. 20, Dado and his friends arrived at Fiji, where no one checked ages or identification, police said.

They headed to Townsend's room in the fraternity, and Dado took several shots of whiskey that Townsend gave him, police said.

Although court documents state that Dado also smoked marijuana with Townsend Sept. 20, Centre County Coroner Scott Sayers maintains that toxicology results did not show that Dado had drugs in his system.

Dado's friends -- roommate Ryan Stroup, 18; Matthew Ludwig, 18; and Eric Hayes, 18 -- all left Fiji at about 2:20 a.m., police said.

Townsend, who turned 21 less than two weeks before the incident, told Dado's friends he offered him a place to stay when he wanted to leave the fraternity, police said.

"He wishes he had done things differently that night," Townsend's attorney Andrew Shubin said. "He grew up with Joe's sister and around Joe's family."

Townsend told authorities Dado "was not sure where he was going and had to be pointed in the right direction" when he left Fiji at about 3:30 a.m. Sept. 20, police said.

"Jack has learned a great deal over the past several weeks -- the toughest and saddest period of his life -- and he believes deeply that this incident should be an important teaching moment for the rest of the Penn State community," Shubin said.

Attending Dado's funeral was "the hardest thing [Townsend] ever did," Shubin said.

Interfraternity Council (IFC) President Luke Pierce said both Fiji and Alpha Tau Omega will remain suspended from the IFC at least until the completion of criminal court proceedings.

But officials from both Fiji and Alpha Tau Omega national headquarters said the fraternities will not have their charters suspended.

"We don't believe that chapter has done anything wrong," Alpha Tau Omega National Headquarters CEO Wynn Smiley said.

Dado and his friends arrived at Alpha Tau Omega with IFC recruitment bracelets after drinking Vladimir Vodka and mixed drinks in Dado's Tener Hall dormitory before taking the bus downtown, police said.

Clifford, of Gibsonia, purchased a bottle of vodka Sept. 18 for Dado, police said.

While at Alpha Tau Omega, the group consumed beer and played beer pong, having about four or five beers each, according to court documents.

"I don't believe that happened," Smiley said.

Following the incident, alcohol has been banned from Fiji, but the charter has not been suspended, Fiji International Executive Director Bill Martin said.

Pierce (senior-economics) said the IFC executives "have confidence" in the Fiji and Alpha Tau Omega fraternity leaders.

"[We] have great appreciation for their cooperation with all investigative parties," Pierce said.

No charges will be filed against anyone for underage drinking in this case because authorities "do not have evidence that would be sufficient," Penn State spokeswoman Annemarie Mountz said.

During the course of the Dado investigation, authorities also found Fiji had furnished alcohol to an underage person Sept. 12, police said. Authorities did not name the underage person related to those separate charges.

Centre County District Attorney Michael Madeira said authorities have come to some "significant conclusions" in the Dado case but that no investigation is ever completely over for those involved.

"There will always be the questions of why and how could this happen," he said.
