Frat supports petition to intervene
The Phi Delta Theta national fraternity filed a brief Wednesday, supporting its petition to intervene in the lawsuit between Penn State and a former Phi Delta Theta chapter.
The national organization believes it has a legal right to the former Phi Delta Theta fraternity house, 240 N. Burrowes Road, and wants the court to recognize this right, according to the brief.
Attached to the brief is a 2008 decision regarding the Delta Delta Delta sorority house at the University of Utah. A court ruled the national fraternity had rights to the property through a three-way relationship that included the students, the house corporation and the national fraternity, according to the brief.
Penn State is currently attempting to purchase the former Phi Delta Theta house through litigation.
