A State College man police say raped an unconscious woman at an October party will face his preliminary hearing Wednesday.
Lying in a bed covered in her vomit, the unconscious woman awoke to Christopher James Smeal, 27, penetrating her vagina with his penis, according to the criminal complaint. Smeal, 109 Sunrise Terrace, was charged with rape, sexual assault and indecent assault on Nov. 17, according to the criminal complaint.
Both were attendees at an Oct. 10 party at Smeal's residence, according to court documents. The woman reported drinking too much alcohol and passing out; after the woman lost consciousness, Smeal and another party guest moved her to a couch, according to the criminal complaint.
The woman was moved again by another party guest to a back bedroom and placed on a bed, according to court documents.
While lying on the bed, the woman vomited on herself and the bed, according to the complaint. A guest took a photo of the woman passed out with vomit surrounding her at 10:01 p.m., according to the complaint. A guest went to the bedroom at about 10:45 p.m. to make a phone call when the guest noticed Smeal in the room with the woman, according to the complaint. The woman told police she was unconscious in the room when she awoke to find herself nude and Smeal having sex with her, according to the complaint. The woman asked Smeal "What are you doing?" and Smeal stopped and dressed himself, according to court documents. Smeal told the woman she had vomited, according to the criminal complaint.
In an interview with police, Smeal said he was in the room with the woman to "make sure she was okay," according to the complaint. He watched her for 10 to 15 minutes and listened to her breathing, according to court documents. He then had intercourse with the woman, including penis to vagina penetration, police said.
