Andrew Rogers, convicted of murder in April 2007, will have to wait at least another month before a judge decides whether he will receive a new trial.
In an evidentiary hearing this morning, Judge Bradley Lunsford made no decision regarding evidence that surfaced after Rogers was convicted of third-degree murder for the February 2006 bludgeoning death of former student Youngcheol Park.
Lunsford set deadlines for both the district attorney's office and the defense to submit briefs.
After the briefs are submitted, Lunsford will issue a decision on whether the evidence -- a description of a man similar to a description Rogers gave of "Sweet," a third man Rogers maintains started the fight that ended in Park's death -- should have been turned over before Rogers' trial, said Roger's attorney, Deborah Lux.
Centre County District Attorney Michael Madeira said the evidence was not introduced because he did not think it was "material."
