Charges were filed Wednesday against Gary Brian Patterson, accusing him of participating in an April on-campus sexual assault of an intoxicated woman, who was so drunk she could not even tell Patterson her name, according to the criminal complaint.
On the morning of April 5, Patterson, 18, engaged in sexual intercourse without the alleged victim's consent, police said. Another juvenile was charged in connection with the incident, Lt. Bill Moerschbacher said, but police are unable to identify the other man or provide relating court documents because he is a juvenile.
Patterson faces charges of involuntary deviate sexual intercourse, sexual assault, aggravated indecent assault, indecent assault, indecent exposure and criminal conspiracy.
Patterson was arraigned yesterday before Magisterial District Judge Carmine Prestia and released on $100,000 bail. Patterson was a student at Penn State Beaver at the time of incident, Moerschbacher said, though he added he could not say for sure if Patterson is still a student there. Amy Krebs, a spokeswoman at Penn State Beaver, could not confirm whether Patterson is still a student there.
The alleged victim was found at 6 a.m. on April 5 by Penn State Police Officer Sean Gorman in the Redifer Commons computer lab, Room 24, visibly intoxicated and wearing nothing but a shirt, according to the complaint. She was transported to Mount Nittany Medical Center for an alcohol overdose, where she was treated and released. The alleged victim had a blood-alcohol content of .32.
The alleged victim returned to the hospital at noon the next day to seek treatment for a possible sexual assault because she didn't know what happened to her between 4 a.m. and 6 a.m. and didn't know what happened to her clothes, according to the complaint.
Semen was located on the alleged victim's shirt and was sent to the lab for DNA analysis, according to court documents.
Though the alleged victim's identity was not released, the Penn State Police Report for April 5 listed an intoxicated female student found at 6:06 a.m. in Room 24 who was then transported to Mount Nittany Medical Center. The investigating officer was Officer Gorman.
In April, Penn State Police posted surveillance photos on Penn State Live of two men suspected to have been involved in an "assault" in the hallway of Redifer Commons. After seeing his photo on the Web site, Patterson identified himself as one of the men in the photo and gave a written statement to Penn State Beaver Police, according to the complaint.
In the surveillance photos obtained by police, Patterson and the other man are observed walking with the alleged victim and holding her up, according to court documents.
In the video, Patterson is seen holding the woman up against a wall, then exposing himself in front of the her and putting her hand on his penis, according to the complaint. The other man then holds the woman under her arms and walks with her off camera, according to the complaint.
A janitor later told police he found clothes matching the description of the alleged victim's clothes in the ground floor restroom of Redifer Commons, according to the complaint. The janitor threw away the clothing, according to the complaint.
Patterson told police he and the other man observed a woman walking near McDonald's he thought was "attractive" and started talking to her, according to court documents. He told police they then went with her to the women's restroom in Redifer Commons and "both had sex with her." He also told police the woman was intoxicated and, at times, he couldn't understand what she was saying.
The alleged victim was unable to identify either man and could not recall anything after she left her friend's apartment at about 4 a.m. on April 5, according to the complaint.
