Trial delayed for man accused of rape
The trial of a Virginia man accused of raping an unconscious female Penn State student was continued to the April term of court because the prosecutor became ill, the defendant's attorney said yesterday.
The trial was originally scheduled to start today.
State College police allege that in September, Justin A. Cluck, 30, engaged in sexual intercourse with a 23-year-old woman while she was unconscious or unaware what was occurring, according to court documents.
The alleged incident took place at a residence on the 1100 block of Smithfield Street, according to court documents.
Centre County District Attorney Michael Madeira said yesterday that the prosecutor, Assistant District Attorney Steve Sloane, has pneumonia.
Cluck's jury selection took place Feb. 6, but another will be scheduled. Bruce Manchester, Cluck's lawyer, said before the last jury selection that he was looking for a "well-seated female jury" to explore their opinions on consciousness. He has said that with the alleged victim's testimony and other evidence, he can prove she was conscious and the intercourse was consensual.
Association schedules open house
The Student Programming Association (SPA) is having an open house today from 1 to 3 p.m. in room 223 of the HUB-Robeson Center to educate students and organization presidents about SPA. SPA -- a newly established organization created to help student organizations' programming efforts -- manages $100,000 of student activity fee funds.
