The attorneys in the case of a Virginia man accused of raping an unconscious female Penn State student in September chose a jury of seven men and seven women yesterday.
According to court documents, State College police said in September, Justin A. Cluck, 30, engaged in sexual intercourse with a 23-year-old woman while she was unconscious or unknowing of what was occurring. The alleged incident took place at a residence on the 1100 block of Smithfield Street, according to court documents.
Bruce Manchester, Cluck's lawyer, said he was looking for a "well-seated female jury."
He said there is one issue in the case -- whether or not the victim was unconscious. Manchester said, with the alleged victim's testimony and other evidence, he can prove she was conscious and the intercourse was consensual.
Centre County Assistant District Attorney Steve Sloane could not be reached yesterday.
Manchester said he was satisfied with the number of women on the jury; however, he took issue with a few of the jurors' answers on the juror questionnaire completed before selection. He could not comment further. The jury includes two alternates. The trial will take place March 2 and is expected to last one day.
