Applegate's blood alcohol concentration (BAC) was found to .208 percent. The legal limit is .08 percent, according to police.

The accident is the second DUI pedestrian accident in less than two months. Penn State student Anthony Torsell, 20, was arrested Oct. 30 after striking two men, killing one and critically injuring another. His BAC was .242 percent at the time of arrest.

According to the accident report, officers responding to the scene reported that Drauch was bleeding from a head wound and had vomited. He did not regain consciousness and was taken to Mount Nittany Medical Center and then transferred to Geisinger Medical Center in Danville.

Police said they also suspect that Drauch had consumed alcohol and are conducting an investigation into who provided him with it.
