A 25-year-old State College resident accused of raping a Penn State student had his bail reduced yesterday after a judge bound him over for trial on charges of rape, sexual assault, aggravated indecent assault, involuntary deviate assault and simple assault.
Centre County Assistant District Attorney Lance Marshall said after the hearing that he was not pleased with the judge's decision to reduce Maurice Golden's bail from $200,000 to $25,000 because of Golden's alleged criminal record, which Marshall said goes back to his youth.
At the hearing, Golden asked a judge to allow him to go back to work while his case moves forward, saying his future is bright.
"A lot of things happened in the past because I had no passion," Golden said. "Allow me to keep working on my future."
Golden is accused of assaulting and raping a 23-year-old student whom said she was in an "intimate relationship" with Golden at the time.
Golden's lawyer, Casey McClain, said his client is claiming the sex was consensual.
The woman testified that she got into a verbal argument with Golden at about 4:30 a.m. on Oct 15 that she said resulted in him straddling her on his bed and strangling her with both hands.
She testified that she had been at a downtown bar and pizza place earlier in the evening, causing her to be late to Golden's apartment, which she said sparked a verbal argument with Golden.
She said she accused him of being with another woman before he strangled her while saying, "Stop, shut up. You pick too much."
The alleged victim then testified that Golden performed oral sex on her and raped her after she repeatedly told him "no."
She said she scratched at his face, pushed his head and chest away from her body and tried to keep her legs closed, but Golden forced her to have sex, she testified.
"I said, 'I am not doing this with you at all,' " the woman said. "He told me 'It's going to happen.' He said the reason why he did it was because he wants me to hate him, never speak to him again and he wants us to end."
McClain asked the woman if she was scared of Golden and if she thought she was stronger than he is.
The woman, who admitted she is twice as large as Golden, said she felt like a helpless child around him, even before the alleged rape.
She testified at yesterday's preliminary hearing that she spent the night at Golden's apartment and went to breakfast with him the morning after the alleged rape.
She said after she went home, she decided their relationship needed to end so she called the police and went to the hospital.
Marshall said it is not unusual for a rape victim to spend time with the alleged assailant immediately after the incident.
Centre County District Judge Thomas Jordan said Golden will have to post $2,500 of his $25,000 bail to be released from Centre County Prison.
McClain said he thinks Golden's family will find the $2,500 to get him out of jail in the near future.
Conditions of Golden's bail reduction were that he remain under intense supervision, that he make absolutely no attempt to contact the alleged victim and that he show up for his remaining court dates.
Golden's arraignment is scheduled for Nov. 21, and McClain said he has already decided to waive that hearing. His next day in court will be Jan. 18, McCla in said.
