Harris' charges may be cleared

Collegian Staff Writer

Former Penn State women's basketball player Jennifer Harris may have July's shoplifting charges expunged after entering the Accelerated Rehabilitative Disposition (ARD), a program designed to give first-time offenders a second chance, according to court documents.

Harris, who filed a federal civil-rights lawsuit against Lady Lion coach Rene Portland for anti-lesbian bias, was sentenced to 15 hours of community service last month. She was charged with shoplifting, after stealing two shirts and two skirts valued at $70 from a store in Harrisburg.

According to Family Service's Web site, the ARD program suspends charges but also requires that certain conditions -- such as community service -- are followed.

Some 30 days after completing ARD, Harris could get the criminal record removed. The only way the crime could again appear on record is if Harris was later charged for another crime.

Harris' lawyers in the federal discrimination lawsuit against Portland could not be reached for comment. But according to The Associated Press, public defender Royce Morris was the acting lawyer in the criminal case.

Morris also did not immediately return phone calls made by The Daily Collegian.

Harris, 21, is currently enrolled at James Madison University in Virginia after transferring from Penn State last year. The former guard played in all 30 games in the 2004-2005 season, while averaging 10.4 points per game for the Lions.

Harris said Portland discriminated against her because the coach falsely believed that Harris was a lesbian. Portland denied the accusations, citing grades and character as reasons why she was dismissed.
