Police say roommate provided beer, rum

Three days after charges of underage drinking were filed against Penn State student Ryan Walton, who fell from a sixth-floor Beaver Hall window after a party, his roommate and another student have been charged with furnishing, serving and consuming alcohol.

Thomas Abraham (freshman-information sciences and technology), Walton's roommate, and Dante Franceschelli (freshman-business) -- both 19-year-olds from Murrysville -- were charged yesterday with furnishing and serving alcohol to minors and underage consumption, which results in three misdemeanor counts against each of them.

Reached by telephone, Abraham said he has not yet received the charges and declined to comment.

Franceschelli could not be reached by press time.

Walton, 19, of Harleysville, fell from the sixth floor of the residence hall March 17 after Penn State University Police arrived at the party. Police said Walton made a rope from a bed sheet and blankets, tied it to the bedpost and climbed out the window while police were interviewing partygoers in the hallway.

Walton is now home and in rehabilitation after sustaining injuries to his back, arms and pelvic area from the 55-foot fall, his father said Wednesday.

According to court documents, police reported to 646 Beaver Hall to assist Residence Life staff with a disorderly party. The occupants of the room allegedly refused to open the door to staff.

Police said an officer knocked on the door, which was opened by a woman after several minutes. Franceschelli, a resident of 646 Beaver Hall, then allegedly became "confrontational" with the officer, according to the criminal complaint.

Police said the occupants of the room later identified Franceschelli as the person who decided not to answer the door to Residence Life staff and who told the occupants to hide.

According to court documents, officers noted 21 people in the room, all of whom were under the age of 21. Police said when they entered the room, the occupants were hiding under blankets and in beds, while beer cans and red plastic cups were scattered throughout the room.

According to court documents, Abraham had allegedly brought about half a case of Natural Light beer, an opened box of Franzia wine and a bottle of Captain Morgan's rum to the party.

University Police Assistant Director Tyrone Parham said Abraham and Franceschelli were charged with not only consuming and possessing but also providing the alcohol.

"One of the big misconceptions out there is that you have to be over 21 to be charged with furnishing," he said. "But the law doesn't have an age."

Parham said the two students obviously must have received the alcohol from someone else who was older than 21, but the police do not have any suspects.

Underage citations were issued to 13 partygoers, including Walton, Tuesday. Abraham and Franceschelli face more serious misdemeanor charges, which carry heavier penalties and fines, in comparison to the others' summary citations, Parham said.
