Freshman caught in drug sales

A Penn State freshman was arrested yesterday after he sold marijuana to an undercover police officer several times on campus.

Thompson Hall resident John Burnley, 19, of Lancaster, sold marijuana at least four times to a Penn State University Police officer.

Burnley is charged with three counts of criminal use of a communication facility, three felony counts of delivery of a controlled substance and three misdemeanor counts of possession of a controlled substance.

On Dec. 3, a confidential informant who knew Burnley met with a female undercover Penn State University Police officer and introduced her as "Jess" to Burnley in an Irvin Hall room.

While they were in the dorm room, Burnley handed them seven small tinfoil packages of marijuana. The undercover officer handed Burnley $160, according to court documents.

The confidential informant asked Burnley if "Jess" could have his phone number so she could call him again in the future. Burnley said, "Sure, I always like to meet new people."

The material inside the packages was tested in a lab, and it was confirmed Burnley sold her 5.9 grams of marijuana.

On Dec. 11, the undercover police officer called Burnley and told him she was interested in buying more marijuana. According to court documents, he said, "Yeah sure, what do you need?"

She told him she only wanted to buy an eighth of an ounce of marijuana because $160 was too pricey. She said she would take a quarter ounce if it would be cheaper, according to court documents.

Later that night, Burnley left the police officer a message that said, "Hey Jess, it's your buddy, J.R. Just give me a call."

She returned Burnley's call and he later sold her a baggie of marijuana for $65 in a Thompson Hall stairwell.

The substance was tested, and it was confirmed that it was 4.6 grams of marijuana, according to court documents.

During the first day of spring semester, Jan. 9, the undercover police officer called Burnley and he agreed to sell her an eighth of an ounce of marijuana for $60 when he returned to Penn State the following day.

On Jan. 11, Burnley called and told her he was in a friend's dorm room in Irvin Hall.

When the undercover police officer arrived at Irvin Hall, she told Burnley to meet her in the lobby. While he was in the commons area of the hall, Burnley removed a small plastic baggie of marijuana from his rear pocket. According to court documents, she then handed him $60 and he told her, "It's sticky so make sure you smoke it out of a bowl, preferably."

The material was tested in a lab, and it was confirmed Burnley sold her 2.8 grams of marijuana.

During a Feb. 14 phone conversation, Burnley agreed to sell the undercover police officer a half ounce of marijuana for $180.

On Feb. 15, Burnley asked the woman to meet him in East Halls. She arrived at Packer Hall and the two walked into the stairwell where he sold her a baggie of marijuana for $180, according to court documents.

Test results showed Burnley sold her 9.9 grams of marijuana.

Burnley was arraigned before Centre County District Justice Jonathan Grine and is in the Centre County Prison in lieu of $16,000 straight bail. His preliminary hearing is scheduled for 8:30 a.m. April 19 at the Centre County Courthouse.
