A man who police say tried to sell an undercover police officer $7,000 worth of OxyContin and morphine pills Tuesday is facing three felony charges.
James R. Frost, 51, of Ephrata, was arrested in the parking lot of Nittany Mall. Police recovered 746 OxyContin pills, 31 morphine pills and a 9-mm handgun from Frost's red Ford pickup truck, according to court documents.
A police informant, accompanied by an undercover officer, spoke to Frost on his cell phone and arranged to meet with him in the parking lot, according to court documents.
In his statement, Frost said he drove to the informant's house before trying to find the parking lot where the informant arranged to buy the pills, according to court documents.
Frost arrived at the parking lot at about 7 p.m. Tuesday and met with the undercover officer and the informant. The undercover officer showed Frost $4,700 he had brought to buy the pills, at which point Frost started to count out pills from a box in his truck, according to court documents.
Several members of the State College Police Department then appeared and took Frost into custody. Frost gave the officers permission to search the truck and told them there was a gun in the driver's side door, according to court documents.
Frost waived his Miranda rights and gave police a statement, which corroborated with the undercover officer's statement of events.
Frost is charged with possession with intent to deliver a controlled substance, criminal attempt and criminal use of a communication facility for using his cell phone to arrange the meeting with the undercover officer.
