Man arraigned in sexual assault case

A State College man was arraigned yesterday in connection with a sexual assault this August in a Nittany Crossings apartment.

Jarvis D. Gilmore, 25, of State College, was charged with sexual assault, a second-degree felony, in connection with the assault of a resident at Nittany Crossings, 601 Vairo Blvd., at about 1:30 a.m. Aug. 28.

The victim told police the night of the assault that she, her roommate and Gilmore went to a few local bars to drink and socialize, according to court documents.

All three returned to Nittany Crossings shortly before 1 a.m., where Gilmore and the victim live in separate apartments, according to court documents.

According to police, Gilmore allegedly went back to the victim's apartment, and the victim said she believed Gilmore was just ensuring she got to bed safely. The victim told police she was intoxicated at the time, according to court documents.

According to court documents, the victim said that Gilmore tried to kiss her, but she initially turned away from him.

She told police that "after a little while, they began kissing."

The next thing she said she remembered, according to court documents, was she was unclothed and Gilmore was allegedly performing oral intercourse on her.

According to court documents, the victim told Gilmore to stop, but she said he did not respond.

She repeated several times she did not want to have intercourse with Gilmore.

The next time she awoke, according to court documents, Gilmore was allegedly having sexual intercourse with her.

When she awoke the next morning before 7 a.m., Gilmore was still in her bed and again, she said, he attempted to have sexual intercourse with her.

The victim told police she left the room, and then Gilmore left the apartment.

According to court documents, the victim said he later admitted to her during a phone conversation that he had had sexual intercourse with her that night.

Lawyers in this case, both for the defense and the prosecution, had not been assigned as of press time yesterday.

Gilmore was committed to Centre County Prison in lieu of $25,000 bail. If he is released, Gilmore will not be allowed to have contact with the victim of the assault.

His preliminary hearing is scheduled for 8:30 a.m. Wednesday at Centre County Courthouse.
