A Johnstown man accused of exposing himself to three women in State College on Oct. 4 was bound over for trial yesterday on a charge of attempted rape.
Fred Dravis, 50, of 122 Geis St., Johnstown, was arrested Oct. 18 and charged with attempted rape, indecent assault, indecent exposure, open lewdness, disorderly conduct and harassment.
Dravis' lawyer, Brian Manchester, said the attempted rape charge is "bogus" and the district judge should have dismissed it. Manchester would not comment on how he would prove that his client is not guilty of the charges during trial.
Two counts of indecent assault were dismissed. Dravis waived his preliminary hearing on charges of indecent exposure, open lewdness, disorderly conduct and harassment.
Manchester said he was angry because the judge implied to the prosecutor that the indecent assault charges, which were dismissed yesterday, could be filed again at a later date and would most likely be bound over in the court.
"It is the judge's job to hear the case and make a ruling," Manchester said. "It is not his job to tell the commonwealth to file a charge."
The charges stem from three separate incidents, which occurred Oct. 4 at Premiere Theatre 12, 125 Premiere Drive, and Carmike Cinema 6, 501 Benner Pike.
Dravis is accused of attempting to rape a 23-year-old Penn State student at about 8:30 p.m. in Premiere Theatre's parking lot. The victim reported she attended a movie by herself and once the movie had already started, a man came in, sat about two seats away from her and began to masturbate, according to court documents.
The State College Police Department said the victim reported that she moved to a different seat, but the man continued to masturbate and stare at her, so she left the theater.
According to court documents, Dravis allegedly followed the victim to her car and as she was attempting to leave, he spun her around and continued to masturbate. The victim said he was able to pull her pants down and allegedly tried several times to engage in vaginal intercourse but was unsuccessful, according to court documents. According to court documents, the man backed away from the victim, ejaculated on her and walked away.
According to court documents, Dravis allegedly exposed himself to another woman about 30 minutes after the Premiere Theatre incident at Carmike Cinema 6, which is about one mile from Premiere Theatre.
State College police said Dravis allegedly sat a few seats away from the victim and began to masturbate. The victim said she left and had no further contact with the man.
Dravis is accused of exposing himself to a third woman at about 9:40 p.m. at Cinema 6, State College police said. The victim said the man came in toward the end of the movie, sat about two seats away from her, and began to masturbate, according to court documents. The victim said she left the theater, and when she came back a few minutes later, the man was gone.
Surveillance footage of Dravis at Premiere Theatre was used to confirm that he was also at Cinema 6 the same night, State College police said.
Manchester said the surveillance footage would be admissible in Dravis' trial.
"I wish they would have video outside. It would totally exonerate my client, but unfortunately there aren't [cameras outside]," Manchester said.
State College police said both Cinema 6 victims viewed the photos of the suspect in the Premiere Theatre incident on the State College Police Department Web site and confirmed that it was the same man.
Dravis' pretrial conference will be held Jan. 26.
