Thirteen Penn State students were arraigned yesterday in connection with an Oct. 24 trespassing incident on the property of Pi Kappa Alpha fraternity, 417 E. Prospect Ave.
Members of the Kappa Delta Rho fraternity, 420 E. Prospect Ave., allegedly entered the Pi Kappa Alpha house without permission on Oct. 24 and demanded the return of their "Chapter Ritual Book," according to court documents on the case.
Ryan Courtney, 22; Michael Dandurand, 24; Scott Donnelly, 20; William Johnson, 18; Jarret Kleppel, 21; Wesley Lewis, 20; Kevin O'Malley, 20; Joseph Recanatini, 19; Ali Ruwaih, 22; James Sisson, 18; and Joseph Sisson, 21; were each charged with one count of misdemeanor trespass and one count of felony trespass.
They were arraigned before District Justice Carmine Prestia and released on $5,000 bail each.
Matthew Magyar, 21, was charged with one count each of felony and misdemeanor trespass and one count of misdemeanor simple assault.
Joseph Flynn, 20, was charged with two counts of harassment, one count each of felony and misdemeanor criminal trespass and one count of misdemeanor simple assault.
Both Flynn and Magyar were released on $10,000 bail.
No members of Pi Kappa Alpha were charged with violations, according to court documents.
The alleged incident occurred at about 2:35 a.m. on the Saturday of Homecoming weekend, when about 30 members of Kappa Delta Rho fraternity entered the front door of Pi Kappa Alpha and fighting broke out, according to court documents.
William Busch of Pi Kappa Alpha suffered a cut on his mouth, and Scott Kubisiak, also of Pi Kappa Alpha, suffered a black eye in the altercation, the documents said.
David Paschkes, an alumnus of Pi Kappa Alpha who was visiting the house, also suffered a broken orbital bone in his left eye after a member of Kappa Delta Rho punched him, according to court documents.
Kappa Delta Rho fraternity is currently on re-organization as a result of the Oct. 24 altercation.
Re-organization status prohibits the chapter from hosting, co-hosting or co-sponsoring events where alcohol is present.
In addition, the fraternity is required to present guest lists for events to the national chapter.
The State College Police Department declined to comment on the charges and the district attorney was unable to be reached for comment.
Preliminary hearings for the defendants are scheduled for April 13.
