DA Gricar drops rape charges
The Centre County District Attorney believed the case was too weak to prosecute.

Centre County District Attorney Ray Gricar dropped charges against a Philadelphia sheriff's deputy accused of raping a State College woman in a hotel in 2003.

William Jimenez, 43, was charged with the rape and sexual assault of the woman after a six month investigation by State College Police.

The case was officially dropped Jan. 7 due to insufficient credible evidence, Julie Confer, a clerk at the district attorney's office, said.

According to court documents, the victim alleged that Jimenez had sexual intercourse with her while she was unconscious, resulting in a pregnancy.

Later paternity testing determined Jimenez was the child's father, though the victim claimed to have never consented to any type of sexual relationship, according to court documents.

At the time of the alleged incident, Jimenez was staying at the Ramada Inn, 1450 S. Atherton St., and attending the Sheriff's Academy at Penn State when he met and began dating the alleged victim.

According to court documents, the alleged victim spent a few nights at the hotel in another room and woke up sick one morning. She accused Jimenez of drugging her and engaging in sexual intercourse while she was unconscious.

Gricar said he determined the woman was "not truthful" in some of her testimony in the preliminary hearing and cross-examination.

"I believe that it would have been impossible to prove beyond a reasonable doubt that she was unconscious as she claimed ..." Gricar said.

He said he has an ethical obligation to drop cases that are too weak to prosecute, but "scenarios like the Jimenez case are extremely rare."
