After two days and 24 prosecution witnesses, the details of what happened in the early hours of Oct. 26, 2003, in the alley behind the All American Rathskeller, 108 S. Pugh St., are still unclear.
The case against Christopher and Jason Rosengrant, who are charged with involuntary manslaughter for the death of Penn State student Salvador Peter Serrano, comes down to a few minutes worth of events.
Yesterday, 19 witnesses testified, including Serrano's fiancée and two friends, bystanders and police officers involved in the case.
Judge Charles Brown, who is presiding over the trial, said there is a possibility that the jury could begin deliberations as early as this afternoon.
The trial was originally scheduled to end today, but during the first day of the trial, Brown said it was more than likely that the court would need another day to complete the arguments from both sides. However, the court was able to finish questioning witnesses more rapidly than expected yesterday.
During the testimony, Penn State student Diana Leonardo said she watched the incident from her Pugh Street apartment.
She testified that she saw a man, presumed to be Serrano, being restrained by two men; one on his side and the other on his front.
"It seemed forceful to me, or unnecessary," she said. "I noticed right away that he was not moving at all."
But Leonardo's testimony was inconsistent with that of other witnesses because in a previous statement that was read at the trial, she identified one of the two men as a black man.
After hearing men and women yelling, Penn State student Michael Aiello watched the altercation from the same apartment as Leonardo. Aiello said he never saw Serrano being pushed, but he did see two men he assumed to be Rathskeller employees lunge at Serrano's upper body.
"I couldn't understand why they needed to restrain him," Aiello said.
But Colin Haughton, another Rathskeller employee who became involved in the altercation, testified that Serrano was being aggressive and "trying to fight." He also said the group of two men and two women were told to leave multiple times.
"They responded to that by coming closer to us," Haughton said.
Former Rathskeller employee Devin Johnson testified that when he arrived on the scene, he saw the Rosengrants holding Serrano on the ground. Johnson said Jason Rosengrant was holding Serrano's shoulders while Christopher
Rosengrant was restraining his lower body.
Johnson testified that Serrano struggled when he was initially being held on the ground but soon stopped. During this time, Johnson was helping to restrain a woman, while observing Jason Rosengrant holding Serrano down with his knee.
However, Johnson said that most of Jason Rosengrant's weight was on the ground, not Serrano's body.
State College Police Officer Kevin Winkelblech, who was the second officer on the scene, said he ran to where Serrano was being restrained by Jason Rosengrant in the middle of Calder Way.
"He was laying face down on his stomach," Winkelblech said.
Winkelblech testified that Jason Rosengrant was in an "X" position on top of Serrano with his chest in the center of Serrano's back, going against the other assertion that the bouncer's knee was in the student's back.
When he realized Serrano's body was limp, Winkelblech said he directed Jason Rosengrant to immediately get off of Serrano, and he complied. Winkelblech said that when he rolled Serrano over, he heard a "gurgling" sound and detected only a weak pulse.
Brooke Morgan, Serrano's fiancée, was involved in the altercation and said she was also restrained. She testified yesterday that she saw Jason and Christopher Rosengrant holding Serrano down on the ground with his arms behind his back and one of them on his legs.
"Those two gentlemen were on Peter," she said, pointing at Jason and Christopher Rosengrant in the courtroom.
However, she said she does not remember which Rosengrant was in which position, or where the other employees were at that time.
"There were five large men then, but I don't remember where [each one was] at that specific time," she said.
