Witnesses say Serrano was not focus of altercation

Though Salvador Peter Serrano's Oct. 26, 2003, death is now the focus of testimony at the trial of Christopher and Jason Rosengrant, many of the witnesses said yesterday that their attention was not on Serrano during the altercation that night.

Ben Hagan, one of the witnesses who testified yesterday, said he worked the light show for the band that played at the All American Rathskeller, 108 S. Pugh St., that night. He viewed the beginning and end of the altercation outside the Rathskeller but said he never saw Serrano. "It wasn't until Sunday or Monday that I saw the paper. ... I didn't know there was a fourth person involved," Hagan said.

He and most other witnesses pointed to the heated exchange between the bouncers and the three other members of the group as the reason no one remembers exactly where Serrano was at most points during the exchange.

Hagan said that after he watched a man get kicked out of the Rathskeller by two bar employees, he followed the men so he could shut the back door behind them.

He added that once he stepped outside, the Rosengrants, two Rathskeller employees, walked toward a group of people in the back alley and said, "You can't be here."

At that time, he only saw two women and one man, who were later identified as Alison Bresnahan, Brooke Morgan and Timothy Padalino.

Tyler Forster said he witnessed the altercation from his apartment building on College Avenue. He testified earlier this year at the Rosengrants' preliminary hearing that there are normally alcohol-related altercations near his apartment on weekends. However, he went to look out a window in the stairwell of his building after hearing what he called extremely loud yelling.

His testimony was heard on a tape recorder at the trial yesterday because Forster was not available to testify in person.

Centre County District Attorney Ray Gricar could not be reached for comment on the reason for Forster's absence.

In the testimony, Forster said that although he saw Serrano fall to the ground during his scuffle with the two Rosengrants, he paid more attention to Bresnahan, who was making more noise.

Police also said they were not immediately drawn to Serrano's presence, but to Bresnahan and Padalino, who were both yelling and struggling with Rathskeller employees.

Sgt. Chris Fishel of the State College Police Department testified that as the first officer on the scene, he first went over to Bresnahan, who stopped yelling when he approached her because she was making the biggest disturbance.

Officer Kevin Winkelblech, who arrived immediately after Fishel, went to where Jason Rosengrant was restraining Serrano.

He testified that he then walked to where Padalino lay on the ground so he could handcuff him.

According to the testimony, when Fishel identified himself as a police officer, Padalino said, "Arrest me. They're crazy. I need air."

Fishel said he thought Padalino's statement was strange but proceeded to put him in the car. At that time, he said Winkelblech informed him that Serrano was not breathing.

It was then that Fishel said he and Winkelblech began to initiate cardiopulmonary resuscitation on Serrano, as other officers and Alpha Ambulance were dispatched to the scene.

Before the altercation, there were some periods of time that Serrano's friends also could not account for his whereabouts.

Bresnahan said that when Padalino left to urinate, she stayed talking with Morgan in Calder Way but did not know where Serrano was.

The next time she saw Serrano was minutes later, when he was already unconscious.

"I then saw Peter on the ground with a lot of people around him ... [and] Brooke severely crying," Bresnahan said.
