Judicial Affairs to review Sothern

An allegation of misconduct by Penn State football player Mike Sothern has been received by the Office of Judicial Affairs and is currently under review, Director of Judicial Affairs Joe Puzycki said yesterday.

"We have received a report," Puzycki said when asked if Judicial Affairs is investigating Sothern's case. "We will follow normal procedures."

Sothern, a redshirt freshman walk-on expected to challenge for the starting middle linebacker spot this fall, will face a preliminary hearing on May 5 on charges of terroristic threats, disorderly conduct and criminal mischief.

According to a State College Police affidavit, the charges filed against Sothern on April 12 stem from an incident that occurred on the night of Feb. 28 when Sothern caused a disturbance in an off-campus apartment hallway, threatened a man and caused property damage.

Puzycki said charges such as terroristic threats are "legal terms" and not part of the code of Judicial Affairs used to make its decision. However, Puzycki said Judicial Affairs is reviewing the allegation "to see if the conduct matches any code violation."

Attempts to contact Penn State Sports Information Director Jeff Nelson for comment were unsuccessful.

Sothern, from Cinnaminson, N.J., played in the Blue-White game 12 days after the charges were filed.

According to the affidavit, the following events happened on Feb. 28 at around 11:36 p.m.:

The victim was visiting his girlfriend's apartment on the first floor of Beaver Hill, 340 E. Beaver Ave., when his girlfriend told him that someone was urinating on the outside of her apartment door.

After the victim's girlfriend shouted at the person to leave, the victim exited the apartment into a common hallway and saw a white man running from the area.

The victim then followed the man, and after he was unable to locate the man, he started walking back toward his girlfriend's apartment.

As the victim neared the apartment door, an unknown man, whom he later identified as Sothern, approached him and called him derogatory names.

According to the affidavit, the victim turned and walked back toward his girlfriend's apartment as Sothern yelled and threatened to kill him.

The victim then continued walking toward his girlfriend's apartment, and when he had almost reached the door, he turned and saw Sothern was still behind him.

Sothern allegedly pushed the victim backward and held him against the wall as he attempted to provoke a fight by asking the victim to hit him.

The affidavit said several witnesses saw Sothern shout, "I am going to kill you," while holding the victim against the wall.

It also said the victim was "scared for his life."

The victim then pushed himself away from Sothern and ran into his girlfriend's apartment.

Sothern allegedly attempted to force his way into the apartment, but the victim pushed him away and slammed the door.

According to the affidavit, Sothern kicked the door 10 to 15 times -- causing $315 in damage -- before leaving.

State College police officer M. L. Rhodes responded to complaints about damage to an apartment door in Beaver Hill.

While on his way, Rhodes saw a man matching the description of Sothern leaving the apartment complex, but he was unable to stop the suspect from leaving, the affidavit said.
