Two men are facing assault charges after a student who was allegedly drinking underage was punched at Alpha Tau Omega fraternity, 321 E. Fairmount Ave.
Matthew Groetsch, 22, and Ryan Gray, 19, a Penn State student, are both charged with simple assault, harassment and disorderly conduct. Alpha Tau Omega is facing a charge of furnishing alcohol to minors.
Neither Groetsch nor Gray is a member of the fraternity.
Preliminary hearings are scheduled for all three cases for March 3 at Centre County Courthouse in Bellefonte. Notification of the charges and summons to appear in court were sent to each of the defendants Monday by mail.
The incident allegedly occurred on Jan. 13, but the 20-year-old victim did not file charges until three days later because he did not know the severity of his injuries. An evaluation by University Health Services determined that the victim had sustained a cracked cheekbone.
A subsequent police investigation ended Monday when the charges were filed against the fraternity and the two men.
Andy Hackett, president of the Interfraternity Council, which governs fraternities, said he could not comment about the case at this time.
"We would have to do the investigation before I could say anything," Hackett said.
Representatives from the fraternity would not comment about the incident because they had not yet received the citation.
According to court documents, the victim attended a party at the fraternity and consumed several cans of beer.
At about 1:30 a.m., two men approached the victim and accused him of inappropriately touching a woman at the party. They identified themselves as the woman's brother and her boyfriend, who was later identified as Groetsch.
An argument ensued, and the victim was asked to leave the premises.
The victim was then attacked by numerous individuals outside the house, including Gray and Groetsch, who both allegedly hit him in the face and body, according to the documents.
Friends helped the victim from the scene.
