Attorneys and family members reacted strongly yesterday after two All American Rathskeller employees were bound over on charges of involuntary manslaughter at the Centre County Courthouse in Bellefonte.
Christopher and Jason Rosengrant will be arraigned on Feb. 9 in connection with the death of Penn State student Salvador Peter Serrano.
Defense attorney Karen Muir said she was obviously disappointed by the ruling but added, "The fight's not over."
She said the testimony of Serrano's fiancée, Brooke Morgan, and the couple who accompanied them that night, Timothy Padalino and Alison Bresnahan, troubled her.
"[The prosecution] is relying on the testimony of people who admittedly can't remember the evening," Muir said.
Gricar said, "The three survivors don't make good witnesses," referring to their inability to recall specific circumstances of the case.
Several of Serrano's family members attended the trial, including both of his parents and an attorney representing the family.
Salvador Serrano, Peter's father, said the Serrano family was pleased with yesterday's ruling.
"I am confident with the way the district attorney handled today's hearing," Serrano said.
The hearing lasted more than eight hours and involved the testimony of over 15 witnesses, with the defense calling only one witness.
Gricar said the complex nature of the case required an extensive preliminary hearing.
"This is not a simple case. We're talking about multiple intoxicated people who got in an altercation at two in the morning, an altercation that was being viewed from multiple vantage points by different witnesses. I wanted to give a full picture of what happened," Gricar said.
Gricar called the evening Serrano died "a sad commentary on a Saturday night in State College."
The comment was in reference to the testimony of State College Police Department officers Kevin Winkelblech and Christian Fishel. Winkelblech had just finished assisting ambulance personnel transport an unconscious intoxicated person to the hospital, while Fishel had just broken up an unrelated fight when they responded to the altercation outside the Rathskeller, 108 S. Pugh St.
Muir said the Rosengrants were receiving continued support from their employer, Rathskeller owner Duke Gastiger. The Rosengrants' parents attended the trial, along with a number of supporters.
"They have a lot of people helping them through this," Muir said.
