Court sentences man for criminal mischief

Troy K. Childers, 207 Rosa Lane, was sentenced yesterday in Centre County Courthouse, Bellefonte, to 11 1/2 to 23 1/2 months in prison and two years probation for criminal mischief and resisting arrest.

Childers, 22, was originally charged with five counts of aggravated assault for allegedly taking close-fisted swings at two officers and kicking three others. Those charges were dropped.

On Jan. 8, Childers ran from police after they responded to a report of suspicious activity at a house on the 400 block of East Foster Avenue, where Childers had entered the back porch illegally and argued with a resident. Childers then punched one officer in the forehead and swung at another before being pepper-sprayed and handcuffed. According to police, Childers' blood alcohol content (BAC) was 0.326 after a blood screening was done at Centre County Hospital.

"[Childers' BAC] is dangerously, dangerously high and it shows a tolerance which would cause anyone else in this courtroom to be comatose," Judge Charles C. Brown Jr. said during Childers' hearing.

Brown said Childers must undergo any evaluation or treatment for alcoholism recommended during his probation. He also ordered Childers not come in contact with the two residents on whose property he trespassed.

Childers has already served 92 days of his sentence.
