A State College man was found guilty Friday on charges of rape, involuntary sexual intercourse and sexual assault for an incident that occurred in August.
Mark-Alonzo Williams, 31, faces a maximum of 20 to 40 years in prison, his attorney, public defender Deborah Lux said.
Lux said she plans to file an appeal saying Williams and the victim, who is a Penn State student, had consensual sex.
The Centre County District Attorney's office was unavailable for comment yesterday.
"The victim maintains he was too drunk and unconscious to give consent," Lux said. "My client maintains he was aware and conscious and took his clothes off. There was consent."
Advocates for sexual assault victims point to the state's sexual assault laws, which require consent before intercourse.
"Generally, laws will say if you're unable to give verbal consent, then the act is considered rape," said Jahnna Harvey, president of the Penn State Feminist Majority Leadership Alliance.
According to police documents, the following occurred during the early morning hours of Aug. 22:
The victim was drinking for several hours at the Shandygaff Saloon, 212 E. College Ave., before catching a bus home at about 12:30 a.m.
The victim got off the bus at the 1100 to 1200 block of North Atherton Street because he was feeling ill and walked to the parking lot of Domino's Pizza, 1100 N. Atherton St., and called his roommates for a ride, when Williams approached him
and asked if he wanted to go to a party where there were "a lot of hot girls."
The victim went with Williams, unaware of where they went, but he said Williams told him they were at The Pointe apartment complex, 501 Vairo Blvd.
After vomiting several times in the defendant's bathroom, the victim said he came out to discover Williams in the living room sitting naked and watching pornography. Williams then told him to take off his clothes because the girls would be there soon.
The victim said Williams then performed sexual acts on him without consent.
Afterward, the victim left and called his roommates, who were still looking for him. When a roommate found him walking along Oakwood Avenue, the victim told the roommate that a man tried to rape him.
After he reported the assault to police, he was taken to Centre Community Hospital for an examination and injuries were present that were consistent with sexual assault.
Lux argued that the injuries are also consistent with consensual sex.
