A New York man was charged yesterday with indecent exposure and indecent assault stemming from an Oct. 6 incident at the Nittany Lion Inn.
Shawn C. Mihalik, 27, of Hyde Park, N.Y., is charged with exposing and rubbing his genitals against a woman in her hotel room.
Mihalik knew the victim but was not staying in the same room, Penn State Police Services said. The two were visiting the university on a business trip.
Mihalik has been mailed a court summons and is scheduled for a Dec. 12 preliminary hearing at the Centre County Courthouse in Bellefonte.
According to the complaint filed with District Justice Carmine Prestia's office, the following occurred during the early morning hours of Oct. 6:
The victim was showering in the bathroom of her room at the Nittany Lion Inn when Mihalik entered the room naked. He then entered the shower.
The victim told Mihalik to leave the bathroom, but he refused. The victim then attempted to exit the shower when Mihalik put up his arm to prevent her from exiting.
Mihalik then pressed his penis against the victim and grabbed her hips in an attempt to prevent her from exiting the shower.
The victim was able to escape and left the bathroom.
The complaint also said Mihalik later spoke to the victim and said, "I am sorry for scaring you."
The complaint also states that Mihalik told police the next day that he did enter the shower stall where the victim was showering. However, Mihalik said in the conversation he believed he had the victim's consent to enter.
Mihalik also said the victim did not seem "receptive" when he entered the shower, and exited as a result.
