Penn State student Edwin McFadden, 22, was charged with failure to disperse, however after testimony from McFadden and State College Police Department officer Robert Bradley, Centre County Judge David Grine dismissed the charge.
According to McFadden's testimony, he had been walking with some friends toward East Beaver Avenue toward Tony's Big Easy Bar, McAllister Alley, when officers in front of him and behind him told him to leave. McFadden said he did not know where to move since he had officers on both sides of him.
Bradley testified that after telling McFadden to leave the area four times, an officer finally tackled him from behind and arrested him.
McFadden said, however, he was asking police where to move to, in response to the police telling him to move.
"I was doing the least threatening thing I could think of to do at the time," McFadden said.
Aside from the 20 arrests, the disturbance resulted in $2,400 worth of damage. Those arrested faced an array of charges that included disorderly conduct, failure to disperse, public drunkenness, harassment, recklessly endangering others, aggravated assault and theft.
Two revelers facing some of the most serious charges will go to trial.
Penn State student Nicholas Baker, 20, is charged with aggravated assault, harassment, disorderly conduct and failure to disperse. He was bound over on all charges yesterday.
Boalsburg resident Mark S. Long, 26, is charged with aggravated assault, two counts of harassment, two counts of disorderly conduct, public drunkenness and failure to disperse. He waived his right to a preliminary hearing yesterday.
Another man arrested on assault charges had his preliminary hearing delayed.
Penn State student Andrew Sedler, 22, is charged with three counts of aggravated assault, three counts of disorderly conduct and three counts of reckless endangerment. The case was continued to another preliminary hearing date, which has not been announced.
Many of the people arrested in the early Saturday morning disturbance will have a pre-trial conference May 22.
