Third rock-tossing suspect charged

Penn State Police Services filed charges by mail against a third Penn State student Wednesday in connection with a Sept. 29 rock-throwing incident.

David Mellet, 18, was charged with one count each of criminal trespass, disorderly conduct and reckless endangerment.

Two other students — Evan J. Gugliuzza, 18, and William P. Loftus, 19 — were charged Oct. 3 for allegedly throwing rocks at three female students from the roof of Shulze Hall. The women, who are black, told police the incident may have been racially motivated, because other non-black students walking nearby were not targeted. However, none of the men have been charged with ethnic intimidation.

Mellet would not comment about whether or not he was on the Pollock Halls dormitory roof, but he said he didn't attack the women. "I wasn't involved with the rocks being thrown at the girls," he said.

Mellet did say, however, that the incident was not related to the victims' skin color. "It wasn't racially motivated," he said.

Mellet said he was unsure of what charges he faces and has not decided how he would plea.

The police took longer to charge Mellet because police did not see him when they arrived Sept. 29 because he was on a different section of the roof than the other two men, Penn State Police Services Officer Randy Hoffman said.

"He wasn't discovered that night," Hoffman said. "He was hiding."

According to a police report, Assistant District Attorney Karen Kuebler heard there was a third male on the roof from a local attorney. When police interviewed Mellet on Oct. 11, he admitted to being on the roof and throwing rocks at a lamppost, the report said. Mellet said there were no pedestrians around when he threw the rocks.

Gugliuzza and Loftus had their preliminary hearings in Centre County Courthouse Wednesday. Gugliuzza was bound over on all charges, and two additional charges of recklessly endangering another person were added. Loftus waived his hearing. The men's pretrial conferences are set for Jan. 25 with criminal jury selection scheduled for Feb. 12.
