SARB investigates King

Undergraduate Student Government President Mike King will be under investigation for allegedly violating the USG constitution. The USG Senate voted last night to authorize the Senate Appointments and Review Board (SARB) Committee to investigate actions taken by King.

Corey O'Brien, USG supreme court chief justice, delivered a letter to King last Tuesday that stated O'Brien will be taking an indefinite leave of absence. King accepted the letter, consulted with members of his administration and decided to promote James O'Rourke, associate justice, to acting chief justice.

However, the Supreme Court Procedures Act states that supreme court nominations must be reviewed by SARB and then approved by the USG Senate. It also states that justices "shall serve unless removed from office by impeachment and conviction, resignation from the Court, graduation, or separation from the University."

SARB Chairwoman Heather Wesley, said O'Brien does not meet any of these requirements for leaving.

"The checks and balances exists for a good reason,"she said.

The Investigation Authorization, submitted by Wesley and Town Senator Mark Sosnowsky, was passed with no objections but five abstentions. Wesley hopes that the investigation will be completed by next Monday in order to bring a focus back to USG in general.

King felt the resolution for the investigation was unnecessary and that he was set up. Although he also stated the intention of the legislation is good because he had planned to explain it in his weekly report.

"I'm fed up with this type of circus act -- you can come into my office and talk to me, there is nothing in the Supreme Court Procedures Act to deal with this type of legislation," he said to the senators.

A day after O'Brien's memo was received, King submitted a letter to Senate President Josh Bokee and Wesley. The letter was addressed to the entire Senate but Bokee and Wesley were the only members given copies -- some of the others felt they were left in the dark.

"In regards to the letter, Josh and I thought we weren't supposed to give it to the senators," Wesley said.

King said he told Bokee he could make copies of the memo, if Bokee wanted. King wrote the memo to get input from the senators, but did not receive any until last night.

O'Brien, who is rumored to be running for USG President in March, is taking his leave of absence due to personal reasons and he said his position is very time consuming -- he spends about 30 hours a week in the office. But he added that he is not bored with USG.

"Politics and campaigning doesn't start until the third week in March," O'Brien said in response to the legislation.
