Charges of reckless endangerment and false imprisonment against a 22-year-old University student were dismissed for the second time Wednesday by District Justice Ronald Horner.
Eric Chrobak was charged with taping his girlfriend's legs and hands together with electrical tape at their 338 W. College Ave. apartment after a brief argument in January, according to court records.
State College Police Lt. Jack Orndorf said the charges were refiled because police believed the charges were proper. He said they acted on the advice of District Attorney Ray Gricar.
The case was dismissed the first time in February by District Justice Robert Shoff, but the State College Police Department decided to refile the case. If one district justice dismisses a case, police can refile the case before another district justice.
State College Police officer James Loesch testified last month that he arrived at the apartment after someone called saying they heard a woman's scream coming from the apartment. Loesch said he knocked on the door several times, but there was no answer. He said he opened the door to find Chrobak's girlfriend tied up and lying on the bed,
Chrobak's girlfriend previously testified that she and Chrobak had an argument, and he left after taping her legs and hands. She testified, in Chrobak's defense, that she knew Chrobak would come back and that he had not hurt her.
