Preliminary hearings

A University student was ordered to stand trial by District Justice Daniel Hoffman yesterday on charges of carrying an unregistered weapon.

According to court testimony, Carlos Rivera, 25, of 349 W. Clinton Ave., was arrested for possession of a handgun after allegedly becoming involved in several altercations throughout State College on Jan. 28.

Kyle Rude, Rivera's attorney, said at the hearing that Rivera had no statement.

Officer Dave Scicchitano of University Police Services testified that University police assisted the State College Police Department in a search for a car containing men who had allegedly been involved in a fight. Scicchitano saw a car matching the description stuck in a snowbank on Pollock Road. Police stopped and searched the men in the car, some of whom were pushing the car out of a snowbank.

University Police officer Ed Waltz testified that he searched Rivera for weapons and found a bulge in Rivera's left jacket pocket. Waltz testified that Rivera said he had a weapon "a second or two" before Waltz found it.

Waltz testified that he found a semi-automatic 40-caliber rifle with a 13-round clip of ammunition. Waltz said he also found another clip containing 10 rounds of ammunition in the front pocket of Rivera's sweatshirt. The sweatshirt was underneath his partially zipped jacket, Waltz said.

Scicchitano testified that Rivera said after the search that he did not have a permit for his weapon and he was aware that he needed one.
