BELLEFONTE -- Former University student James M. Roberts Jr., charged with raping a female student in October, was bound over for trial yesterday in Centre County Court.
Roberts, 21, who has been free on $10,000 bail and resides in Pittsburgh, is charged with two counts each of rape and indecent assault and one count of attempted rape.
A trial date has not been set.
Roberts allegedly raped the woman in his apartment, located at 131 Sowers St., after returning from a fraternity party sometime in the early hours of Oct. 13, according to court records.
The alleged victim testified for almost two hours, frequently becoming both agitated and impatient during cross-examination.
The woman said she and Roberts were playing a "beer for beer" drinking contest, which began in his apartment and continued when they and some friends went to a fraternity party.
"Jamie kept pressuring me to drink," she said, adding that Roberts was not drinking as much as she was. The woman testified that a few days after the alleged rape occurred, Roberts said he was sober during the incident.
The victim, the only witness Assistant District Attorney Eileen Tucker called to testify, said she asked a friend in their group not to leave her alone with Roberts because he was "being strange."
She testified that she became intoxicated at the fraternity party, and Roberts said, "We're leaving now. Your friends have left," and pushed her out of the fraternity house.
But the woman said that while the two were walking home, her friends came up to them and said they never left the fraternity. Roberts, who was literally preventing the woman from falling, deliberately lost the woman's friends and took her back to his apartment against her wishes, she said.
"It was a school night, and I didn't want to spend the night at Jamie's place," she said, adding that she intended to call her roommate from Roberts' apartment.
The woman testified that when they returned to his apartment, she collapsed on the floor. Roberts then allegedly told her he had called her roommate, she said. Roberts said the roommate did not want the plaintiff to return to the dorm, she testified.
Roberts also forced her to swallow a Benadryl pill at some point during the night, she said. The woman said Roberts threw her on a bed and began to kiss her, repeating her name over and over.
"I said, 'What the hell are you doing?,' "she testified, adding Roberts told her to "shut up."
After a period of time, Roberts allegedly removed her clothes and raped her.
On cross-examination, Defense Attorney Tim Fleming asked her why she did not walk away from Roberts as they were leaving the fraternity.
The woman answered, "As strange as it may seem, it is not safe to walk home alone drunk in State College."
