Man charged with attempted murder is released

BELLEFONTE -- A State College man charged with attempting to murder one of his roommates the night of Feb. 15 was released on nominal bail Friday afternoon after a bail reduction hearing before Judge Charles C. Brown in Centre County Court.

Robert E. McMillan Jr., 23, who is charged with attempting to murder Rickey Poe, 1005 N. Atherton St., was released Friday.

During the hearing Poe told the court that he is not worried about McMillan's release. "I'm not afraid of him and I don't think he means me any harm," he said. Poe added that he wanted the charges against McMillan dropped.

Centre County Assistant District Attorney Karen Arnold, who is prosecuting the case, said the Commonwealth plans to continue prosecution of this case even though Poe does not want charges filed against McMillan. She also asked that McMillan not be released because the case involves more than just Poe's personal injuries.

Two conditions of McMillan's release are that defense attorney Deborah Lux be notified of McMillan's location at all times and that McMillan does not transport or consume any alcoholic beverages.

Poe testified during a preliminary hearing on Feb. 21 that McMillan was intoxicated at the time of the Feb. 15 incident.

McMillan was charged with criminal attempted homicide, aggravated assault and terroristic threats after he allegedly stabbed Poe in the hand with a 10- to 12-inch butcher knife. The stabbing reportedly resulted from an argument about money, according to District Attorney Ray Gricar could not be reached for comment Friday afternoon.
