The Eric Epp/Sue Donohue ticket has filed a complaint against the Jim Van Horn/Denys Wilmer ticket for inspiration of religious prejudice, said Head Elections Commissioner Brien Kocher.
Van Horn asked Epp during last week's crossfire session at the Undergraduate Student Government presidential debate if the U.S. Constitution and the Bible contradicted one another, which one he would follow?
"The motive was to inspire prejudice against me because of my religion," Epp said.
Donohue would not comment about the complaint.
"I prefer not to say anything right now," Donohue said. "I don't want to say anything that would jeopardize or hurt Mr. Van Horn's campaign without thinking about it."
Van Horn said he wanted to see if Epp and Donohue would follow their consciences or their constituents.
"I was simply trying to clarify comments he said to other groups," Van Horn said. "I heard him on occasion stress the importance of his religious values.
"I am a Roman Catholic," Van Horn added. "I have the same beliefs. I wouldn't want to slander myself."
According to Article IV, Section 1, part 2 of the election's code, candidates are forbidden to encourage or inspire prejudice against another candidate on account of religion, race, sex, national origin, sexual orientation or political affiliation.
Epp wanted to have a hearing to get grievances in the open so they would not continue.
"There have been some problems with that candidate," Epp said. "He has been hard to deal with. I think his motives are unfair. Filing a complaint gives you a chance to air grievances."
Epp said he had other grievances against the Van Horn/Wilmer ticket and that he may file more complaints against them.
Kocher said the hearing will probably be tomorrow.
The hearing will be conducted by an elections code hearing board, which was created last night by the USG supreme court. The hearing board will be composed of the former elections court.
Last week Dennis Pollard, chief justice of the USG supreme court, gave an injunction to the elections court because of inconsistencies in the Elections Code about the elections court.
Kocher said this will make it difficult to hold a hearing.
"We not only have to get the candidates together but the whole elections court," he said.
Kocher added that he would try to mediate between the two candidates to avoid a hearing.
