Edward P. Zemprelli, indicted Feb. 22 on charges in an alleged $57 million conspiracy, will stay an active member of the University Board of Trustees and attend the board's next meeting March 16 and 17, said J. Lloyd Huck, board president.
"He remains a full-fledged member of the board," Huck said. "He has been indicted, but not convicted of anything."
Zemprelli, former Democratic leader in the state Senate, was one of five men named in an 87-count indictment by a federal grand jury in Pittsburgh. The five are charged with defrauding investors in a company that claimed to sell interest in tax-sheltered real estate and made false statements to the Internal Revenue Service.
Zemprelli did not return a message left with his office yesterday.
The board will take no action to suspend Zemprelli or restrict his activities, Huck said. Zemprelli serves as chairman of the board's Milton S. Hershey Medical Center Committee. He also sits on the Trustee Presidential Selection Committee which will choose a successor for University President Bryce Jordan who retires Aug. 31.
Huck said he did not expect board action would be necessary even if Zemprelli's case went to trial.
"If he felt he was in a situation in any way embarrassing to Penn State, I think he would withdraw himself," Huck said.
Also indicted in connection with the activities of Earned Capital Corp. were Thomas J. Reilly, Evans City; Philip H. Joyce, Bridgeville; Frank P. Wayhart, Pittsburgh; and James C. Chotiner, listed as an inmate in a New Jersey prison.
